(Victoria Times Colonist) – A police officer who is already facing two charges of assault will not be charged over a third accusation.
Const. Geoff Mantler was charged last month with assault after Buddy Tavares was kicked in the face while being arrested in January. Mantler is also charged with assaulting Manjeet Singh Bhatti and causing him bodily harm on Aug. 30 last year.
Mantler was investigated for use of excessive force after Jeremy Packer claimed he was attacked in Kelowna on Aug. 10 while repossessing a boat.
The justice branch said Thursday that a court was unlikely to find Mantler’s use of force in the Aug. 10 incident excessive, and that there was no substantial likelihood of conviction.
“Const. Mantler’s recollection is that he struck the complainant several times, possibly two or three times, on the back, right side of the head because the complainant was resisting [arrest], but did not strike him again after he presented his hands,” the branch’s statement reads.
