Mountie says romp with co-worker was consensual

A night of alleged drunken sexual activity between two off-duty RCMP officers was consensual and not pre-meditated, the accused told court yesterday.

The 34-year-old male constable based out of Morris testified the complainant, a 24-year-old woman, did not object to repeated sexual contact, and eventually presented her naked body to him at a Winnipeg home in the early hours of March 20, 2005.
DENIED SUGGESTIONS
He was suspended from duty just over a month later and charged with sexual assault in May 2005.

The two Mounties first met the night of the alleged incident and were introduced by the brother of the accused, who is an RCMP officer who trained the accuser in Fisher Branch.

The accused denied suggestions by the Crown that he entered the woman’s bedroom with sexual intentions after ensuring no one else in the home was awake.

The man said he asked permission to sleep in the complainant’s bed after expressing concern for her drunkenness and “doesn’t know how” they ended up embracing and kissing some time later.

He said that contact eventually led to other consensual sexual activity, but denied claims the pair had intercourse.

The woman testified Tuesday that she told him to stop once, but blacked out a few more times and awoke to a different sexual act each time.

“When I woke up again he was on top of me and was having intercourse,” she said.

During cross-examination she said she did not scream, call for help or attempt to get out of bed.

When questioned about her sobriety, the woman said she was “pretty drunk” after working a full day and forgetting to eat before drinking six alcoholic beverages at a Winnipeg bar.

Court will hear closing arguments this morning.
