A veteran Surrey Mountie has been acquitted of using undue force in the arrest of Harminder “Harry” Khosah during a domestic dispute nearly three years ago at Khosah’s home.
RCMP Const. Drew Grainger was one of three officers who responded to the residence the night of Sept. 16, 2004, after a 911 call from one of Khosah’s two teenaged sons.
Khosah’s family said at Grainger’s trial that Khosah was drunk and threatening his wife and children the night of the incident, although Khosah denied he was intoxicated.
The commercial truck company owner later released video surveillance tapes from his home showing the altercation.
In the judgment in Surrey provincial court, Abbotsford-based Judge Kenneth Skilnick noted police must be given some leeway when dealing with difficult situations like that night’s 911 response.
Grainger’s accuser didn’t survive to state his case. Khosah, then 43, was killed following an unrelated fight at his home on Feb. 13, 2006.
