B.C. court awards woman hit by RCMP car $1.2M

(Canwest News Service) – A woman has been awarded more than $1 million after the car she was riding in was hit by an RCMP cruiser that ran a red light in Langley, B. C.

The accident in October 2002 left Erin Towson with a mild brain injury, chronic pain and subsequent bouts of depression.

Towson, 31, was a passenger in a car being driven by her boyfriend when it was struck by a police cruiser driven by Const. Manuel Pizarro.

He was responding to a gun call and had his emergency lights on, but had shut off the siren before driving through the red light.

Pizarro was found liable because he failed to stop at the intersection to ensure it was clear. The law allows police to drive through a red light without stopping if both siren and emergency lights are activated.

B. C. Supreme Court Justice Victoria Gray awarded Towson nearly $1.2 mil-lion in various damages and costs.

Pizarro, a 15-year veteran, was suspended without pay on Jan. 4, 2008, after he was involved in an unrelated Insurance Corp. fraud. After a hearing in 2005, Pizarro was ordered to resign but he is appealing that decision, Vancouver RCMP Const. Annie Linteau said Friday.

  1. I have always been told when you enter an intersection with or without lights and noise you are still responsible for doinf so SAFELY….
